2. Filing a Takedown Notice
If you believe content on FreeMix infringes your copyright, you may submit a written takedown notice to dmca@freemix.fm.
Your notice must contain:
- Your physical or electronic signature
- Identification of the copyrighted work you claim is infringed
- Identification of the infringing material on FreeMix (URL or description sufficient for us to locate it)
- Your contact information: name, address, phone number, and email address
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
3. What Happens After a Takedown
Upon receiving a valid takedown notice, we will:
- Review the notice promptly
- Remove or disable access to the allegedly infringing content
- Notify the uploader that their content was removed and explain why
- Provide the uploader with information about filing a counter-notification
4. Counter-Notification
If you believe your content was removed in error or is not infringing, you may file a counter-notification. Your counter-notification must contain:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and phone number
- A statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or any judicial district in which FreeMix may be found if your address is outside the United States)
- A statement that you will accept service of process from the person who filed the original takedown notice or their agent

5. Restoration
If we receive a valid counter-notification, we will forward a copy to the original complainant and inform them that we will restore the removed content in 10-14 business days.
If the original complainant does not notify us that they have filed a court action seeking to restrain the allegedly infringing activity within that period, we will restore access to the content.
6. Repeat Infringer Policy
FreeMix maintains a repeat infringer policy in accordance with the DMCA. Users who receive multiple valid DMCA takedown notices will have their accounts permanently suspended.
We track takedowns and counter-notifications to identify repeat infringers. The number of strikes required for termination may vary based on the severity and nature of the infringement.
7. Good Faith
FreeMix will not tolerate abuse of the DMCA process. Filing a false takedown notice is a violation of federal law (17 U.S.C. § 512(f)) and may result in liability for damages, including costs and attorneys' fees.
We reserve the right to take action against users who file fraudulent takedown notices, including account suspension.
